Special Act on the Promotion of the AI Data Center Industry (Korea)
Passed by the National Assembly on 7 May 2026 and promulgated on 9 June 2026 as Act No. 21759. It takes effect nine months after promulgation.
Three provisions matter for planning: a one-stop approval system with a permit timeout mechanism; exemption from the power grid impact assessment for certain non-capital-region AI data centres; and eased facility installation requirements.
Scope is not yet fixed. The size threshold for exemption is still to be set by enforcement decree, so an exemption cannot be assumed at this stage.
Domestic usage abbreviates the facilities as AIDC. The exemption clause is the reason developers have begun looking outside the Seoul metropolitan area.
Projects breaking ground now have not been exempted — they passed the assessment. Conflating the two leads to a planning error.
Reported draft thresholds differ between sources (100 MW versus under 50 MW for the non-capital exemption). This page records that the range is under discussion rather than picking one.
